In 1990, Leonard Allen was convicted of Aggravated Murder in Montgomery County and sentenced to life in prison. While serving his sentence at Lebanon Correctional Institution, Allen accused another inmate, Derek Sanders, of being a snitch. Subsequently, on December 24, 1993, Allen approached Sanders as he was standing in the doorway of his cell located on the second floor of E Block. Upon approaching Sanders, Allen lunged at him and stabbed him in the side with a sharp object.
Inmate Sanders was transported to the Middletown Regional Hospital for initial treatment to his injuries, which included a stab wound to the right chest. Thereafter, he was evacuated to the Ohio State University Hospital where he underwent surgery to treat his injuries.
Following a jury trial in Warren County, Allen was convicted of Felonious Assault and the specification that he had previously been convicted of an offense of violence. He was sentenced to a term in prison of not less than ten (10) nor more than fifteen (15) years, which was to run consecutively to the sentence he was serving from Montgomery County for Aggravated Murder.
Additionally, the Court specified that the minimum sentence of ten (10) years would be served as “actual incarceration” as provided by law, as it existed in 1994.
